EUGENE, Ore. - The family of a person shot and killed by police in front of a middle school January 11 wants access to video of the incident as well as the autopsy report and other "investigatory materials."
Attorney Lauren Regan from the Civil Liberties Defense Center in Eugene and the family of Charles Landeros held a press conference Tuesday.
"They want access to the video tape that we know exists," Regan said. "The school had a number of surveillance cameras and we believe officers were wearing badge cameras. The family wants to at least view that immediately and then have access to all of the reports, including the autopsy report and investigatory materials, as soon as possible."
Regan said the family intends to retain experts to conduct an independent examination and investigation of the evidence.
Police shot and killed Landeros, 30, in front of Cascade Middle School on Friday.
Officers responded at 10:27 a.m.
According to police:
Eugene Police responded to a custodial dispute involving an adult male at Cascade Middle School, 1525 Echo Hollow Road. As officers were escorting the male from the school, he produced a firearm and a struggle ensued. During the struggle the subject was shot by police and is now deceased. This occurred outside of the school.
Under Oregon law, the use of deadly force by police requires a probe by the county Interagency Deadly Force Investigation Team.
The team - made up of law enforcement professionals from other state, county and local jurisdictions - will conduct an investigation and compile a report.
State law tasks the county district attorney with reviewing the investigation and determining whether or not police were justified in using deadly force.
"The IDFIT Team follows the same protocol on each of these investigations. It is very important that the investigation not be compromised by the release of information before interviews are complete and evidence is gathered," Lane County District Attorney Patty Perlow said Monday in response to media inquiries. "Because the investigation is ongoing, I would not expect the release of information this early in the process."
